1. Acceptance of Terms

By accessing or using the LoyalBean Cafe Owner mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

LoyalBean provides a digital coffee loyalty platform connecting cafe owners with customers. The Service allows cafe operators to manage loyalty programs, scan QR codes, track customer visits, and access business analytics.

3. User Accounts

3.1 Account Creation

  • Users must provide accurate and complete information
  • Users are responsible for maintaining account security
  • One account per cafe operator is permitted

3.2 Account Termination

  • LoyalBean may suspend or terminate accounts at any time without notice
  • Users may delete their accounts through the application settings

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LOYALBEAN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

LoyalBean disclaims all warranties regarding:

  • Accuracy - No guarantee that point balances, rewards, or information are accurate
  • Availability - No guarantee of uninterrupted service access
  • Functionality - No warranty that the Service will meet your requirements
  • Security - No guarantee against data loss or unauthorized access
  • Customer Participation - No control over customer behavior or redemption patterns

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOYALBEAN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

In any event, the total liability of LoyalBean shall not exceed $10 USD, regardless of the cause of action.

6. Loyalty Points and Rewards

  • Cafe owners control their own loyalty program structure and reward values
  • Loyalty points have no cash value
  • Points cannot be transferred between users
  • Points may expire without notice based on cafe policies
  • LoyalBean may modify point tracking mechanisms at any time
  • Reward fulfillment is the responsibility of the cafe operator

7. User Responsibilities

Users may not:

  • Use the Service for illegal purposes
  • Attempt to manipulate point balances or rewards
  • Share account credentials with others
  • Create multiple accounts
  • Use automated tools or scripts
  • Misuse customer data or violate customer privacy

8. Fair Use Policy

LoyalBean is designed to support independent coffee shops with normal business operations. We reserve the right to evaluate usage patterns to ensure fair and appropriate use of our service.

8.1 Extraordinary Usage

Extraordinary usage may include, but is not limited to:

  • Processing an unusually high volume of customer transactions that significantly exceeds typical cafe operations
  • Using the service for purposes other than managing a single coffee shop's loyalty program
  • Sharing account access across multiple unrelated businesses or locations
  • Automated or systematic usage patterns that indicate service abuse or exploitation
  • Any activity that places an unreasonable burden on our infrastructure or support resources

8.2 Usage Evaluation and Action

LoyalBean monitors service usage to maintain platform integrity and ensure fair access for all cafe partners. If we determine that your usage pattern constitutes extraordinary usage:

  • We will attempt to contact you to discuss the usage pattern and resolve any concerns
  • You may be required to upgrade to a plan that accommodates your usage needs (when such plans become available)
  • If appropriate arrangements cannot be made, we reserve the right to suspend or terminate your subscription
  • Refunds will not be provided for the current billing period if termination occurs due to extraordinary usage

9. Legal Protections

BY USING THIS SERVICE, YOU WAIVE ANY RIGHT TO PURSUE LEGAL ACTION AGAINST LOYALBEAN, ITS OWNERS, EMPLOYEES, OR AFFILIATES.

Any disputes must be resolved through binding arbitration. Users waive the right to jury trials, class action lawsuits, and court proceedings.

10. Service Modifications

LoyalBean reserves the right to modify or discontinue the Service at any time without notice. We have no obligation to provide advance notice of changes or maintain backward compatibility.

10. Subscription Pricing and Billing

The LoyalBean Cafe Owner App operates on a subscription basis with the following terms:

10.1 Pricing

  • Monthly subscription fee as displayed in the Google Play Store at time of purchase
  • 14-day free trial for new subscribers
  • Automatic billing begins after trial period unless subscription is cancelled
  • Payment processed through Google Play Billing

10.2 Price Changes

WE RESERVE THE RIGHT TO MODIFY SUBSCRIPTION PRICING AT ANY TIME. ACTIVE SUBSCRIBERS WILL RECEIVE 30 DAYS ADVANCE NOTICE OF PRICE CHANGES.

By continuing your subscription after the notice period, you accept the new pricing. You may cancel your subscription at any time to avoid future charges.

10.3 Billing and Cancellation

  • Subscriptions automatically renew monthly unless cancelled
  • Cancel anytime through your Google Play Store account
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused time
  • Access to the Service continues until the end of the paid period

10.4 Termination for Extraordinary Usage

LOYALBEAN RESERVES THE RIGHT TO IMMEDIATELY TERMINATE SUBSCRIPTIONS FOR EXTRAORDINARY USAGE AS DESCRIBED IN SECTION 8 (FAIR USE POLICY).

Subscription termination due to extraordinary usage:

  • May occur without prior notice in cases of severe abuse
  • Will result in immediate loss of access to the Service
  • Will not be eligible for refunds for the current billing period
  • May include suspension of ability to create new accounts

10.5 Beta Limitations

  • One cafe location per subscription during beta
  • Multi-location support not available during beta period

11. Beta Service Limitations

During our beta period, the Service has the following limitations and conditions:

  • Feature set may change without notice as we iterate and improve
  • Best-effort support only; no guaranteed response or resolution times
  • Access and availability may be interrupted during beta for maintenance and upgrades
  • Analytics and reporting features may change or be removed
